These terms and conditions outline the rules and regulations for the use of BARGE ON DEMAND Website, located at https://bargeondemand.com.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Barge On Demand if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "User", “You” and “Your” refers to you, include all “Clients” or "Partners", the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the user in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Indonesia. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Who can apply for CLIENT registration?

In order to apply for CLIENT registration, the company must have mining, trading, production business, coal business etc. and must be registered under law of any particular country. Following company or person meeting all the minimum requirements can become a CLIENT:

• PT PMA, Local PT Company registered under law of Indonesia.
• Limited Liability or Partnership Company.
• Any other organization related to below business registered under Indonesian Law or Law of Singapore or any country.
• Mining Company or its associate, Trading Company or its associate, Export /Import Company etc.
• The applicant must have valid company registered under Indonesian Law and having valid NIB and IZIN USAHA, Company Registration Certificates.
• The applicant must have NPWP/Tax number of Director in case of Individual and NPWP of Company in case of Company.
• The applicant must provide correct legal company name, address and contact information and an email address that can be used for this company account. This email account should be set up already, as you will start receiving important emails from PT. ETRADE TRANS WORLD almost immediately.
• The applicant must have a current bank account on compnay name. Bank Mandiri will be preferred.

CLIENT Code of conduct

• Agreement shall be in between USER and BARGE ON DEMAND (PT. ETRADE TRANS WORLD).
• Provide accurate information to BARGE ON DEMAND (PT. ETRADE TRANS WORLD) all the times.
• Act fairly and not misuse ’s BARGE ON DEMAND (PT. ETRADE TRANS WORLD) features or services.
• Not attempt to circumvent the BARGE ON DEMAND (PT. ETRADE TRANS WORLD) business process.
• CLIENT acknowledge that they have executed this agreement in the English language, which shall be the governing language.
• CLIENT acknowledge that they have executed this agreement in the English language, which shall be the governing language.
• Neither party shall assign any part of this agreement, rights or obligations, to another party without the prior written consent of the other.
• Any Damage like Stevedoring damage -if any- to be settled directly between ship (Mother Vessel) owner and stevedoring company, In case of any damage to the Mother Vessel or the Floating Crane caused directly by the Barge or any damage to the barge and/or tug caused by the mother vessel or the Floating Crane, the same is to be settled directly between barge/tug company. The BARGE ON DEMAND is to assist the Barge/Tug company and/or Stevedore company in obtaining settlement.

Violating the Code of Conduct or any other BARGE ON DEMAND (PT. ETRADE TRANS WORLD) policies may result in actions against your account, such as cancellation of listings and suspension or forfeiture of payments. More details about these policies are below.

Who can apply for PARTNER registration?

In order to apply for PARTNER registration, the most important part is to have Barges or Stevedore or Chemical Spray services for Coal Business. Following company or person meeting all the minimum requirements can become a PARTENR:

• Individual with NPWP and KITAP.
• Limited Liability or Partnership Company.
• Any other organization related to below Business registered under Indonesian Law.
• Owner of Barges, Stevedore Company, Floating Crane Company, Chemical Spray Company, Shipping Company.
• The applicant must have valid company registered under Indonesian Law and having valid NIB and IZIN USAHA, Company Registration Certificates.
• The applicant must have NPWP/Tax number of Director in case of Individual and NPWP of Company in case of Company.
• The applicant must provide correct legal company name, address and contact information and an email address that can be used for this company account. This email account should be set up already, as you will start receiving important emails from PT. ETRADE TRANS WORLD almost immediately.
• The applicant must have a current bank account on compnay name. Bank Mandiri will be preferred.

PARTNER Code of conduct

This policy requires that PARTNER act fairly and honestly on Barge on Demand to ensure a safe and trusted business experience. PARTNERS must:

• Agreement shall be in between PARTNER and BARGE ON DEMAND (PT. ETRDAE TRANS WORLD).
• Provide accurate information to BARGE ON DEMAND (PT. ETRADE TRANS WORLD) all the times.
• Act fairly and not misuse ’s BARGE ON DEMAND (PT. ETRADE TRANS WORLD) features or services.
• Not attempt to circumvent the BARGE ON DEMAND (PT. ETRADE TRANS WORLD) business process.
• PARTNER must fulfill his commitment of services and cannot cancel after signing the confirmation and signing the contract. If issue or problem faced by PARTNER in Barges or his services allocated by PARTNER, then PARTNER can replace the Barge with other Barge in next 24 hours else any cost associated with these services shall be at PARTNERs account.
• PARTNER acknowledge that they have executed this agreement in the English language, which shall be the governing language.
• Neither party shall assign any part of this agreement, rights or obligations, to another party without the prior written consent of the other.
• Any Damage like Stevedoring damage -if any- to be settled directly between ship (Mother Vessel) owner and stevedoring company, In case of any damage to the Mother Vessel or the Floating Crane caused directly by the Barge or any damage to the barge and/or tug caused by the mother vessel or the Floating Crane, the same is to be settled directly between barge/tug company. The BARGE ON DEMAND is to assist the Barge/Tug company and/or Stevedore company in obtaining settlement.

Disclaimer of warranties and limitation of liability

The BARGE ON DEMAND SERVICES and all information, content, materials (including software) and other services included on or otherwise made available to you through the BARGE ON DEMAND SERVICES are provided by BARGE ON DEMAND on an "as is" and "as available" basis, unless otherwise specified in writing. BARGE ON DEMAND makes no representations or warranties of any kind, as to the operation of the BARGE ON DEMAND SERVICES, or the information, content, materials (including software) or other services included on or otherwise made available to you through the BARGE ON DEMAND SERVICES, unless otherwise specified in writing.

BARGE ON DEMAND does not warrant that the barge on demand services, information, content, materials (including software) or other services included on or otherwise made available to you through the BARGE ON DEMAND SERVICES, BARGE ON DEMAND'S servers or electronic communications sent from BARGE ON DEMAND are free of viruses or other harmful components. to the full extent permissible by law, BARGE ON DEMAND will not be liable for any damages of any kind arising from the use of any BARGE ON DEMAND SERVICE, or from any information, content, materials (including software) or other services included on or otherwise made available to you including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

Site policies modification and serviceability

BARGE ON DEMAND reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Applicable Law

Any and all dispute (“Dispute”) in connection with this Agreement or the execution thereof shall be settled through friendly negotiations. In case no settlement can be reached through negotiations after 30 Business Days from the date such Dispute has been notified by the claiming party to the other party, then the Parties (PARTNER and BARGE ON DEMAND) agree to refer to and settle such a Dispute (“Dispute”) by arbitration in Singapore administered by the Singapore Chamber of Maritime Arbitration (“SCMA Rules”) in accordance with the Arbitration Rules of the Singapore Chamber of Maritime Arbitration (“SCMA Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this Clause.
